These Terms of Use ("Terms") are an agreement between you ("you", "User") and NEW BUILDING CORPORATION LLC ("Company", "we", "us", "our"). These Terms govern your access to and use of Hubz AI, our mobile application that enables generation of images and videos using third-party APIs, our website, and related services (collectively, the "Service").
To use the Service, you may be required to sign in using Sign in with Apple and/or Google.

You must be at least 13 years old (or the minimum age required by law where you live) to use the Service.
We may modify the Service and/or these Terms at any time. We will post updated Terms on our website and update the "Last updated" date. By continuing to use the Service after changes take effect, you agree to the updated Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use, unless we explicitly state otherwise.
You are responsible for obtaining and maintaining any devices, equipment, and internet or mobile network connection necessary to access the Service. Your mobile carrier or internet provider may charge you for data usage or other fees, and you are responsible for any such charges.
The Service may offer auto-renewable subscriptions, including a weekly plan and a monthly plan (availability and pricing may vary by region). Subscriptions are processed through Apple In-App Purchases. We do not receive or store your payment card details.
Your subscription may automatically renew unless canceled at least 24 hours before the end of the current period, in accordance with Apple's rules. You can manage or cancel your subscription in your Apple ID settings. Refunds (if any) are handled by Apple under Apple's policies.
Subscription plans may include generation credits that become available after you purchase or renew a subscription. You may use the credits available in your balance at any time during your active subscription period (subject to these Terms and technical limits needed to keep the Service reliable).
We will show your current credit balance in the app. Credits do not roll over when the subscription period ends, unless we explicitly state otherwise in the app at the time of purchase.
The Service may offer one-time purchases of additional credits ("Credit Packs") as consumable in-app purchases. Credit Packs are used to pay for generation requests. Credit availability, pricing, and pack sizes are shown in the app at the time of purchase, including in a dedicated credits/top-up section.
If we receive a refund request for an in-app purchase, we may provide Apple with information reasonably necessary to evaluate the request and prevent fraud or abuse. This may include: time since install, total app usage time, an anonymized account identifier, whether the in-app purchase (credits) was fully or partially consumed, whether the in-app purchase included a free trial, and purchase and refund amounts, to the extent available and permitted by Apple's policies and applicable law.
The Service enables generation of images and videos based on your inputs (e.g., prompts, reference media, settings) and may rely on third-party AI providers or aggregators. You acknowledge and agree that:
You may provide content to the Service (e.g., prompts, text, images, audio, videos, and other materials) ("Inputs"). You retain ownership of your Inputs.
You grant us a limited, worldwide, non-exclusive license to host, process, reproduce (solely as technically necessary), transmit, and display your Inputs and generated outputs ("Outputs") only to operate the Service, provide the features you request, maintain safety, and improve reliability (e.g., debugging and fraud prevention), in the minimum scope necessary.
As between you and us, you may use Outputs you receive from the Service, subject to: (a) these Terms; (b) applicable law; and (c) any restrictions imposed by third-party AI providers used to generate the Outputs. We do not guarantee that Outputs are unique or that you will have exclusive rights to any Output.
You agree that you will not, and will not attempt to:
Where the Service relies on sign-in (e.g., Sign in with Apple or Google), you agree not to create or use multiple accounts or multiple email addresses to abuse free trials, bypass subscription requirements or credit limits, evade enforcement, or otherwise deceive the Service.
We may remove, restrict access to, or disable any inputs or outputs (and may suspend or terminate accounts) if we reasonably believe they violate these Terms, applicable law, or third-party rights, or if necessary to protect the Service, users, or our rights. We are not obligated to monitor content, but we may do so.
The Service integrates with or relies on third-party services, including a routing/aggregation provider (xskill.ai) and third-party model providers (for example: Kling, Nano Banana, Seedance, Hailuo, Seedream), as well as cloud infrastructure, analytics, and payment platforms like Apple. Third parties may have their own terms and policies. To the maximum extent permitted by law, we are not responsible for third-party services outside of our reasonable control.
The Service, including its software, design, trademarks, and other content (excluding your Inputs), is owned by the Company or its licensors and is protected by applicable laws. No rights are granted except as expressly stated in these Terms.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that outputs will be accurate, safe, or suitable for any purpose.
We are not responsible for any failure or delay in performance of the Service to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, failures of telecommunications or internet service providers, power outages, or other force majeure events.
To the maximum extent permitted by law, in no event will the Company be liable FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.
To the maximum extent permitted by law, the company's total liability for any claim arising out of or relating to the service will not exceed the amount you paid (if any) for the subscription or credit packs during the three (3) months immediately preceding the event giving rise to the claim, or usd $0 if you paid nothing.
To the extent permitted by law, you agree to indemnify and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your Inputs/Outputs; or (c) your violation of these Terms, applicable law, or any third-party rights.
We may suspend or terminate your access to the Service at any time if you violate these Terms, if required by law, or to protect the Service, users, or our rights.
Sections that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will survive termination.
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with any policies referenced herein (including our Privacy Policy), constitute the entire agreement between you and the Company regarding the Service and supersede any prior or contemporaneous agreements and communications.
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law rules. Any dispute will be resolved in the competent courts of the Republic of Armenia, unless mandatory law provides otherwise.
